ATCO responds to Section 19 and 22 guidance

A response has been made by the Association of Transport Coordinating Officers (ATCO) to the DfT’s recent guidance issued on Section 19 and 22 operators (see B&CB’s special report on this in issue 1442, 11 August 2017). ATCO brings together local authority staff members that are responsible for passenger transport. Its advice into the situation is that it would not be “prudent” to award new contracts to community transport groups until issues are resolved. However, it does not believe Councils should make any changes to existing contracts they hold with Section 19 and 22 groups until further advice is received by the DfT or DVSA, “as current contracts were issued in good faith and in line with thinking at the time.”

ATCO says it has not had time to undertake a full review of the implications of the guidance or discuss it with the DfT. It has requested a meeting with the government body “at the earliest opportunity”.
